Judge dismisses Oklahoma town's water lawsuit

MUSKOGEE, Okla. (AP) - A federal judge has dismissed a lawsuit that challenged a state law requiring legislative approval before the city of Hugo can sell water to North Texas. Attorney General Drew Edmondson, whose office defended the lawsuit, said Monday it was filed by the cities of Hugo and Irving, Texas.
Hugo wants to sell Oklahoma water to Irving and claimed in the lawsuit that requiring legislative approval is unconstitutional. Edmondson says the federal judge disagreed. Edmondson says Oklahoma is blessed with an abundance of water. He says the state should complete its comprehensive water plan so future generations will have access to clean, plentiful water. Officials say the ruling was handed down by a judge in Wichita, Kan., after federal judges in Muskogee recused themselves.
